Welcome to Nini. We operate Nini and other related services that refer to or link to these legal terms (the “Legal Terms”) (collectively referred to as the “Services”).

You can reach us at hi@getnini.com. These Legal Terms form a binding agreement between you (“you” or “the user”) and Nini regarding your access to and use of our Services. By using or accessing the Services, you confirm that you’ve read, understood, and agreed to these Legal Terms.

We may occasionally update these Legal Terms and any related policies or supplemental documents posted within the Services. Updates will be noted by changing the “Last Updated” date. By continuing to use the Services after updates, you agree to the revised Legal Terms. We recommend reviewing these Terms periodically to stay informed.

1. OUR SERVICES

The Services we provide are not intended for access or use in any location or jurisdiction where doing so would breach any law or regulation or would require us to register within such jurisdictions. By choosing to access the Services from outside our operating regions, you are solely responsible for ensuring compliance with any relevant local laws.

These assets are protected by copyright, trademark, and various other laws regarding intellectual property and unfair competition worldwide. All content is provided in or through the Services “AS IS” and is intended solely for your personal, non-commercial, or internal business use.

Authorized Use of Our Services:

• Download or print a copy of any accessible content solely for personal, non-commercial, or internal business use.

To use the Services, content, or trademarks in any other way, please contact us to seek permission. Any infringement of these intellectual property rights will result in immediate loss of access to the Services.

3. SUBSCRIPTION AND PAYMENTS (DREAM PASS)

Access to certain premium features of Nini, including the ability to create new stories, requires an active subscription to our premium plan, known as the Dream Pass.

• Story Creation: Creating new stories is only available to users with an active Dream Pass subscription.
• Access to Existing Stories: To listen to previously created or downloaded stories, an active Dream Pass subscription is required.

Subscription Terms:

• By subscribing to Dream Pass, you agree to pay the associated fees.
• All payments are non-refundable unless required by law.
• You may cancel your subscription at any time. However, access to premium features will continue until the end of the current billing cycle.

4. USER REPRESENTATIONS

1. You have the legal capacity and agree to follow these Legal Terms.
2. You are not a minor in your jurisdiction.
3. You will not use automated or non-human methods to access the Services.
4. You won’t use the Services for any unlawful or unauthorized purpose.
5. Your usage complies with all applicable laws and regulations.
6. You are not located in a country under U.S. Government embargo or designated as supporting terrorism.
7. You are not listed on any U.S. Government list of prohibited or restricted parties.

If you provide any false, inaccurate, outdated, or incomplete information, we reserve the right to suspend or terminate your account.

5. FAIR USAGE POLICY

To maintain fair and enjoyable access for all users, accounts are intended for individual use only. Sharing your account login credentials with others is strictly prohibited.

Additionally:

• High Usage Limits: Excessive story creation in a short period may result in temporary pauses before you can continue.
• Automated Use: Using bots, scripts, or automated tools to interact with the Services is strictly prohibited.

6. PROHIBITED ACTIVITIES

You agree not to:

• Collect or harvest data or other content from the Services without permission.
• Deceive, mislead, or defraud us or other users.
• Interfere with any security features of the Services.
• Frame or link to the Services without proper authorization.
• Transmit material containing viruses or harmful code.
• Use the Services in an automated or unauthorized way.
• Utilize the Services to compete with us.

9. LIMITATIONS OF LIABILITY

The Services are provided “AS IS” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties and are not liable for any indirect, incidental, or consequential damages resulting from the use of the Services.
